These Terms of Use (the “Terms”) govern your use of cherrytreesurgical.com (the “Site”), operated by Cherry Tree Surgical, LLC (“Cherry Tree Surgical,” “we,” “us,” or “our”). By using the Site, you accept these Terms. If you do not agree with them, please do not use the Site.

1. The Site is informational — not medical advice

The Site provides general information about Cherry Tree Surgical and the procedures we perform. That information is not medical advice, diagnosis, or treatment, and it is not a substitute for consultation with a qualified physician. Viewing the Site, or contacting us by phone, does not create a physician–patient relationship. Never disregard or delay seeking professional medical advice because of something you read on the Site.

2. No guarantee of results

Descriptions of procedures, technology, and lenses on the Site — including the possibility of reduced dependence on glasses — are general in nature. Surgical outcomes vary from patient to patient, and no particular result is promised or guaranteed. Whether any procedure is right for you, and its risks, benefits, and alternatives, can only be determined in consultation with your surgeon.

3. Appointments and eye exams

Cherry Tree Surgical performs eye surgery only and does not conduct eye exams. Exams and appointments are arranged through May Eye Care Center, a separate practice with its own website and policies.

4. Intellectual property

The Site and its content — including text, graphics, logos, images, video, and design — are owned by Cherry Tree Surgical, LLC or its licensors and are protected by copyright, trademark, and other laws. You may view and print pages for your personal, non-commercial use. Any other reproduction, distribution, or use of the Site’s content, including our names and logos, requires our prior written permission.

5. Acceptable use

You agree not to use the Site unlawfully, attempt to interfere with its operation or security, probe or breach its infrastructure, or use automated means to access it in a way that burdens or disrupts it.

6. Third-party sites

The Site links to third-party websites (such as Google Maps, mayeyecare.com, and mayaisolutions.com) for convenience. We do not control and are not responsible for third-party sites, and linking to them is not an endorsement. Your use of those sites is governed by their own terms and policies.

7. Disclaimer of warranties

The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Site will be uninterrupted, error-free, or secure.

To the fullest extent permitted by law, Cherry Tree Surgical, LLC will not be liable for any indirect, incidental, special, or consequential damages arising out of or relating to your use of, or inability to use, the Site. These Terms govern only your use of the Site: nothing in them limits or modifies any right or obligation relating to medical care provided at our center, or any liability that cannot be limited under applicable law.

9. Governing law and venue

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. Any dispute relating to the Site will be brought in the state courts of York County, Pennsylvania, or the United States District Court for the Middle District of Pennsylvania.

10. Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted on this page with a revised effective date, and your continued use of the Site after that constitutes acceptance of the updated Terms.

11. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
